I guess whoever gets custody of the children, if children are present, should "get the house".

If it turns out that there are no children, then I feel that if it's a situation where one of the two acted unfaithfully, then the one who didn't "break the vows" get to keep the house.

If it turns out that both just want out for whatever the reason (grew apart; just don't love one another romantically anymore, etc.), then it should probably go to the one who can't afford to leave or the one with the lower income or if not that, then they should just share the place and just live like two roommates, especially if both invested in the property and are on decent terms with one another.

I was in a long term relationship with a lady and even though we were not married we bought a lot of things together. When we broke up things were so bad that I just left everything there. I know most people may not agree with this decision but I was able to recover and get my own things again. Sometimes people don't have money for lawyers and all of the legalities that come along with it. In this case the person who is less fortunate probably will end up being arrested or with restraining orders placed against them. In these cases I would say that it is best to just leave unless the two parties are able to come to a civilized conclusion. I would also say that everyone needs a basic knowledge of the law. This is why so many people get away with so many things.

I just got out of a 5 year relationship earlier this year, other than the child we had togther we shared everyting except the mortgage. It got sooo bad that I took my baby and walked away, the only thing i took was my truck that he bought. My friends thought i was crazy but its not worth the stress. I can buy new stuff:p

I hope I never end up in the situation, although, I haven't much of a desire to get married. I still think of marriage as being "owned", somewhat, even though I've never witnessed this type of thing in my life. Meh. To me, a marriage is supposed to be a partnership. Seems like the logical thing to do.

Anyway, seems that stuff should be split down the middle, right? It should be mandatory by law, imo. Now if there's a house involved, as both parties would've contributed to that, it would probably be best just to sell it, split the money up equally, and just buy cheaper places.

True, your husband will be your "owner". Your WORTH will be determined by how well or how poorly you treat your man! :)

It's supposed to be partnership. Everything is supposed to be 50-50 and equal. A married couple is supposed to work together. No one person is supposed to have control over the other or more control over the other. They're both supposed to contribute to the household, and if both partners are actually working, then it's obviously the right thing to do.
